Arms sale to Israel again dodges Congressional approval. “For the second time this month the Biden administration is bypassing Congress to approve an emergency weapons sale to Israel as Israel continues to prosecute its war against Hamas in Gaza under increasing international criticism. Social media blamed for influencing, instead of reflecting, public sentiment. “Young people are overwhelmingly unhappy about U.S. policy on the war in Gaza? Must be because they get their “perspective on the world on TikTok” — at least according to Senator John Fetterman, a Democrat who holds a strong pro-Israel stance. This attitude is shared across the aisle. “It would not be surprising that the Chinese-owned TikTok is pushing pro-Hamas content,” Senator Marsha Blackburn said. ….Consumers are unhappy with the economy? Surely, that’s TikTok again, with some experts arguing that dismal consumer sentiment is a mere “vibecession” — feelings fueled by negativity on social media rather than by the actual effects of inflation, housing costs and more. ….Back in 2008 and 2012, Facebook and big data were credited with helping Barack Obama win his presidential races. Congress reviewing U.S. government ‘watchlists’. “Earlier this month  CBS News broadcast an in-depth report confirming that more than two million names (up from 1.75 million names in 2019) are now on U.S. government blacklists (euphemistically described as ‘watchlists’) restricting travel and other rights. CBS also interviewed some of the U.S. citizens who, without ever being accused of any crime or having their day in court, and for no reason they know or that the government will tell them, have been stopped at gunpoint, delayed, or prevented from flying. Less than a week later, the Senate Homeland Security and Government  Affairs Committee (HSGAC) released a detailed staff report on the same issue, ‘Mislabeled as a threat: How the terrorist watchlist & government screening practices impact Americans‘. The Chair of the HSGAC, Sen. Gary Peters (D-MI), also sent a formal request to the Inspectors General of each of the federal departments that participate in the ‘Watchlisting Council’,  asking [them] to ‘coordinate on an assessment of the full implementation of the Terrorist Screening Dataset’. ….The same day, five other Senators and eight members of the House of Representatives sent a joint letter about ‘watchlisting’ practices  to the heads of the Department of Justice, FBI, Department of Homeland Security, Transportation Security Administration, U.S. Customs and Border Protection, and several other agencies. Donald Trump not the first non-Confederate candidate to be barred from office under the 14th Amendment. “In 1910, [socialist Victor Berger] won a seat in Congress representing Milwaukee, Wisconsin, and served a single two-year term. After being defeated in 1912, Berger remained active in left-wing politics and opposed America’s entry into the First World War. In 1918, he was convicted (along with several other Socialist [Party] organizers) of having violated the Espionage Act of 1917, which effectively criminalized any criticism of the war effort. Officially, Berger was found guilty of 26 ‘disloyal acts’ related to a series of editorials published by the Milwaukee Leader, a paper Berger helped run, arguing against America’s involvement in the war. Despite that conviction—or perhaps because of it—Berger was elected to Congress again in 1918. His campaign called for the country to respect free speech and freedom of the press, and he continued to push for an ‘early, general, lasting and democratic peace’. ….Congress refused to seat Berger when he showed up to work in January 1919, on the grounds that his Espionage Act conviction was tantamount to engaging in insurrection against the country. The vote was nearly unanimous, 311-1, with the lone dissenting vote cast by a Wisconsin Republican. A special election was held in December 1919 to fill the still-vacant seat, and Berger won again—this time earning even more votes than he had a year earlier. Again, a majority in Congress voted to block Berger from taking his seat. ….the U.S. Supreme Court decided that [Judge Kenesaw] Landis should have recused himself from [Berger’s Espionage Act] case due to [anti-German] prejudice and threw out Berger’s conviction on the grounds that he did not receive a fair trial. Russia’s barrage of missiles and drones targeted Ukrainian industrial and military sites, about 30 killed. “Gen. Valery Zaluzhny, Ukraine’s top commander, said the attacks had also targeted critical industrial and military facilities. ….In the center of [Kyiv], the Artem factory, which the Ukrainian authorities say manufactures missiles and aircraft parts, was engulfed in columns of smoke. ….A few miles away, columns of thick black and white smoke billowed from a warehouse. Illinois cops no longer allowed to pull over motorists just because of air freshener hanging from rear view mirror. “Starting Monday, police there no longer will be allowed to pull over motorists solely because they have something hanging from the rearview mirror of the windshield. That means air fresheners, parking placards and, yes, even those [fuzzy] dice…. A North Carolina law will require pornographic website operators to confirm viewers are at least 18 years old by using a commercially available database. The law lets parents sue companies if their children were allowed to access the pornography. ….[Hawaii] is replacing gender-specific terms in state law; ‘mother’ is being replaced with ‘birthing parent’ and ‘father’ with ‘non-birthing parent’. Austin caller who reported ‘man with a rifle’ is fatally shot after pointing BB gun at responding officers. “When two uniformed APD officers arrived at the scene minutes later, they reported seeing [Konrad] Khorshahian pointing what looked like a rifle at them as they drove through the lot. ….APD says the officers took cover and repeatedly ordered Khorshahian to drop the weapon over the next few minutes. ….Khorshahian yelled for the officers to shoot him. ….one officer fired his gun, striking and killing Khorshahian. California to cover all undocumented residents under state’s health insurance plan. “For the first time, undocumented immigrants of all ages will qualify for Medi-Cal, California’s version of the federal government’s Medicaid program for low-income people. The new guidelines will make California the only state to fund comprehensive health care for undocumented immigrants beginning Jan.1, 2024. ….The program expansion is expected to provide health coverage for about 700,000 undocumented residents between the ages of 26 and 49, according to Sen. Durazo. In 2015, the state began to allow undocumented children to receive health care through Medi-Cal and then in 2019, the eligibility guidelines were extended to include those 26 years old or younger. Hazardous waste facility in Bridgeport, CT explodes. “Fire officials said the building belongs to Tradebe Environmental, a company that disposes and recycles hazardous waste. Tradebe Environmental confirmed one of their tanks exploded and further say they are cooperating and working closely with first responders and regulators. ….Officials say three people were injured and sent to local hospitals. Two were being treated for burns and one was being treated for smoke inhalation. ….Fire marshals said the building was secure and residents were allowed back into their homes. Gov. Kathy Hochul sides with insurance companies and businesses, vetoes bill that would have allowed damages for emotional suffering in wrongful death lawsuits. “New York is one of just a few states that account only for economic loss in wrongful death lawsuits. New Jersey man faces terrorism charges after posting about ‘jihad in the U.S.’ on X, traveling to Africa to join Islamist extremist group. “The FBI has arrested Karrem Nasr, 23, of New Jersey for allegedly attempting to provide material support to the African-based terrorist organization al Shabaab after they claim he became inspired to wage Jihad following the October 7 terrorist attacks [on Israel]. ….According to the complaint, Nasr flew from Egypt to Kenya on December 14 to try and join the terrorist organization, charging documents say. Nasr was allegedly communicating with an FBI confidential source in which he said the number one enemy was ‘evil America’ and in social media posts in November he allegedly posted on X ‘jihad on your home turf. Oregon hospital calls police to have man ‘with no medical problems’ removed, who then dies while being transported. “As officers entered [Providence Milwaukie Hospital], [Jean] Descamps was groaning and not responding to questions. He appeared to not be in good health despite hospital staff’s claims there were no medical problems and he was cleared for release. ‘He was pleasant, he was conversant the entire time until right when his discharge arrived,’ a staffer said. ‘He’s not thriving but there’s no medical reason for him to be here anymore. and it’s all behavioral, yep, 100% behavioral.’ ….Eventually police handcuffed him and got him into a wheelchair to take him to the police cruiser. They decide to take him to the behavioral health center. ….But shortly after they arrived and talked with him, they realized he was unresponsive. Within seconds officers pulled Descamps from the cruiser, removed his cuffs and began CPR. Most Illinois sheriffs say they won’t enforce state ban on military-style rifles. “Since the start of the year, a majority of county sheriffs in Illinois have stated that they don’t plan to enforce the Protect Illinois Communities Act, a sweeping ban on assault weapons and high-capacity ammunition magazines state lawmakers passed in January. What the sheriffs oppose specifically is PICA’s effect on private assault weapon owners. The law not only prohibited the sale and purchase of new assault weapons and high-capacity magazines, but also forbid, with some exceptions, their private ownership. One of those exceptions was a grandfather measure ensuring those who already owned assault weapon could keep their guns and weapon accessories so long as they registered them with the Illinois State Police before New Year’s Day, 2024. Since the registration portal opened in October, [only] about 52,000 people have done so. After New Years Day, at least in theory, anyone found owning an unregistered assault weapon or extended magazine could face criminal penalties. But in the days after Democratic Gov. J. B. Pritzker signed PICA into law, sheriffs across the state issued statements saying they believe the bans violate the Second Amendment. Though a few sheriffs who opposed the ban, like Will County Sheriff Mike Kelley, simply voiced their opposition without saying what it means in practical terms, dozens of others weren’t so coy. ….Courthouse News reached out to multiple Illinois state attorneys, specifically in counties where sheriffs had opposed the assault weapon ban, to ask if they would consider action against their county sheriffs. California appeals court rules in favor of plaintiffs seeking police misconduct records. “When SB 1421 went into effect on Jan. 1, 2019, numerous police unions sued to stop demands for records. ….In a 30-page opinion, Justice Carin Fujisaki wrote that [Senate Bill 1421] indeed applies retroactively and ‘supersedes state law disclosure exemptions’ that ‘pose a direct conflict with its decree that records within its scope are not confidential and shall be made available to the public.’ The only exception to this, the appellate court found, would be attorney-client communications. Local leader of Alexei Navalny’s anti-corruption group sentenced to nine years in prison. “A Russian court on Friday sentenced Ksenia Fadeyeva, who led jailed opposition leader Alexei Navalny’s now-banned organization in the Siberian city of Tomsk, to almost a decade in prison, her supporters said. Donald Trump barred from second state’s Republican primary ballot.The move [by Maine’s] secretary of state – following a similar decision from the Colorado Supreme Court earlier this month – worsened a growing crisis for Trump’s campaign and strengthened the rationale for the US Supreme Court to take up the issue, arising from the 14th Amendment’s ‘insurrectionist ban’. ….two states have now found that a former president engaged in an insurrection against the US government – an unheard of state of affairs at any other moment in history. Surveillance video shows Oxford, OH police officer repeatedly punching restrained college student. “A video circulating on TikTok shows an Oxford police officer striking Devin Johnson, who is a Miami University student, who was being held by Brick Street Bar staff while the officer tried to make an arrest around 1:30 a.m. Nov. 18. ….The department said when they originally reviewed the November incident, they didn’t have that camera angle. They now have opened a use of force investigation, and officer Mathew Blauvelt has been placed on administrative leave. ….The video does not show what led to the incident, but according to court documents, police say Johnson ‘entered Brick Street through a side access against the wishes of bar staff’ and then was confronted by the bar manager. Johnson then allegedly ‘refused to leave’ and ‘assaulted bar staff’. Police said it then led to a fight outside the bar with bar staff, which is where the TikTok video begins. Brick Street declined to comment on the matter. After he was arrested, Johnson was charged with assault, resisting arrest, criminal trespassing and underage possession of alcohol. Johnson is scheduled to be in court on Jan. 25. Robert F. Kennedy Jr. campaign submits enough signatures to appear on Utah’s presidential ballot. “Robert F. Kennedy Jr. has met the signature requirement to qualify to be on Utah’s 2024 general election presidential ballot, the Salt Lake County clerk’s office confirmed to CBS News Thursday, pushing the independent candidate one step closer to getting on the ballot in that state. ….Once Kennedy officially files, Utah would mark the first state’s ballot for which he has qualified. …. Towns in Pennsylvania and Delaware break rainfall records. “The heavy rain overnight targeted Philadelphia, New York City and New Haven, Connecticut. ….Several cities in the mid-Atlantic saw daily records on Wednesday, including Allentown, Pennsylvania, which received about 2.05 inches of rain. That topped the previous record of 1.55 inches, which was set in 1930. ….Mount Pocono’s rainfall hit 1.49 inches, beating the 1.39-inch record set in 2011. Google settles lawsuit over tracking ‘incognito’ Chrome users. “Now, after a failed attempt to get it dismissed, the company has agreed to settle the complaint that originally sought $5 billion in damages. According to Reuters and The Washington Post, neither side has made the details of the settlement public, but they’ve already agreed to the terms that they’re presenting to the court for approval in February. When the plaintiffs filed the lawsuit, they said Google used tools like its Analytics product, apps and browser plug-ins to monitor users. They reasoned that by tracking someone on Incognito, the company was falsely making people believe that they could control the information that they were willing to share with it. Judge upholds California’s content moderation disclosure law. “X sued California in September to undo the state’s content moderation law, saying it violated free speech rights under the U.S. Constitution’s First Amendment and California’s state constitution. Today, U.S. District Judge William Shubb dismissed the social media company’s request in an eight-page decision. The law requires large social media companies to issue semiannual reports that describe their content moderation practices. Hospitals bought by private equity investors more hazardous for patients, claims study. “The sweeping study, which was published Tuesday in the journal JAMA, looked at the rates of 10 serious adverse events associated with medical care at 51 hospitals before and after they were purchased by private equity firms — a financing model designed to make money for investors. The researchers then compared those results with the rates of the same complications at 259 hospitals that were not owned by private equity firms. ….All told, researchers analyzed the outcomes of nearly 5 million hospitalizations, which were available through Medicare claims data. Researchers had at least three years of data on each hospital included in the analysis. Woman sues after school district police officer allegedly rear-ended her motorcycle at stop light, put her in chokehold. “[Samantha] Magallanes was riding her motorcycle with a group of friends and stopped at a red light on the night of June 23 at the intersection of Joe Battle Boulevard and Montana Avenue when [Officer Armando] Ulloa crashed into the back of her motorcycle, the lawsuit states. Relatives claim detained Kashmir men were tortured by Indian authorities.According to their relatives, the three men—Mohammad Showkat, age 22; Safeer Hussain, 45; and Shabir Ahmad, 32—were among eight people detained in Topa Pir in Poonch district early on Friday, a day after unknown assailants killed four Indian soldiers and wounded several others in an ambush near the village. The men were members of the Gujjar, traditionally a pastoral mountain people. The intruders, who were all arrested, were reportedly angry at the government over its economic policies and lack of job opportunities. Opposition MPs have been calling for the prime minister, Narendra Modi, and the home minister, Amit Shah, to address parliament about the incident and debate the matter in the house. However, the BJP speaker has refused to let the debate go ahead, saying the security breach is not within the purview of the government. Engine company hit with record fine for emissions cheating. “Truck engine maker Cummins Inc. has agreed in principle to pay a $1.675 billion fine for installing devices on hundreds of thousands of engines to allow them to emit excess pollution, the largest-ever civil penalty for a Clean Air Act violation, the U.S. Justice Department said on Friday. The Department said Cummins allegedly installed so-called ‘defeat devices’ to bypass or disable emissions controls such as emission sensors and onboard computers. Police body camera video hasn’t solved the problems of excessive force and bad conduct. “‘Departments across the country have routinely delayed releasing footage, released only partial or redacted video or refused to release it at all,’ write [journalists] Eric Umansky and Umar Farooq. ‘They have frequently failed to discipline or fire officers when body cameras document abuse and have kept footage from the agencies charged with investigating police misconduct.’ Their review of 79 police killings captured by body camera footage in June 2022 found that footage has only been made public in 42% of cases. Another limitation of body camera footage is that it relies on subjective interpretation. When TheGrio news network recently sent footage of the same police use-of-force incidents to 10 experts, interpretations of what they saw and heard varied dramatically, even on basic matters including whether or not the subject complied with officer demands. …. NYPD agrees share body camera video with police oversight agency in a timely manner. “The New York Police Department has agreed to end its practice of withholding body-camera footage of police shootings from civilian investigators, a practice that sometimes derailed independent inquiries into deaths at the hands of police. The change came weeks after ProPublica and The New York Times Magazine asked the NYPD about the practice as part of their investigation into the use of body cameras. For years, the Civilian Complaint Review Board, which is charged with investigating police misconduct in New York City, has often been hamstrung in its ability to move ahead on the most serious cases because the NYPD refused to share footage of shootings and other serious incidents while the department did its own, often lengthy, internal investigation. ….The new agreement between the NYPD and CCRB, which was signed Dec. 5, stipulates that the Police Department will hand over footage and other records within 90 days of a request. In 2023, journalists in the U.S. were also subjected to 30 subpoenas/legal orders, 11 prior restraints, 11 chilling statements, 11 instances of equipment damage, seven denials of access, four equipment searches or seizures, and 44 assaults. ….Multiple reporters were criminalized for routine news-gathering practices, like ‘asking too many questions’ or ‘publishing’. ….Camryn Sanchez, a journalist in Arizona, was served a restraining order filed by state Sen. Aurora, CO paramedics found guilty of criminally negligent homicide in death of Elijah McClain. “The 23-year-old Black man was walking home in 2019 when he was confronted by police officers who forcibly restrained him [and choked him unconscious – PNS] and then the Aurora Fire Rescue paramedics — Jeremy Cooper and Peter Cichuniec — injected him with ketamine. He went into cardiac arrest in an ambulance a few minutes later and died three days later. ….During closing arguments on Wednesday Colorado Solicitor General Shannon Stevenson told jurors the paramedics did not conduct basic medical checks of McClain such as taking his pulse before giving him the ketamine. ‘There was no justification not to assess Mr. McClain. There was no justification to give someone who was not moving a sedative,’ Stevenson said. ‘The defendants knew the risk of giving an overdose of ketamine.’ ….This was the third and final trial for the five first responders who were charged in McClain’s death. Residents of Illinois who own semi-automatic firearms with certain cosmetic features or types of magazines must register them with the state by January 1st. “A federal judge Friday declined to stop Illinois’ assault weapons registry from going into effect. Judge Stephen McGlynn from the U.S District Court for the Southern District of Illinois denied a request from several gun rights groups to issue an injunction blocking the registry. The law banning assault weapons is already in effect. The registry applies to people who owned now-banned assault weapons and assault weapon attachments before Illinois Gov. JB Pritzker signed the bill into law Jan. 10. Gun owners have until Jan. 1 to register their weapons and attachments. Governor of New York signs bill moving local elections to even years to increase turnout. “Gov. Kathy Hochul signed legislation Friday to move most local elections to even years, which will align the normally low-turnout local municipal races with ballots for president, Congress and governor. The move… was welcomed by voting suffrage groups and many Democrats, who are most likely to benefit from the change. Tacoma, WA police officers found ‘not guilty’ in deadly arrest of Manuel ‘Manny’ Ellis. “Christopher Burbank, 38, and Matthew Collins, 40, were each found not guilty of second-degree murder and first-degree manslaughter, while Timothy Rankine, 34, was found not guilty of first-degree manslaughter. ….Ellis, an unarmed, 33-year-old Black man, died on March 3, 2020, after he was restrained, beaten, tased and put in a spit mask by law enforcement, according to prosecutors. Huntsville, AL settles excessive force lawsuit of intellectually disable man for $600,000. “The lawsuit claims Jeffrey Burton was hospitalized for five days after he was slammed to the ground, handcuffed and shocked with a stun gun by Huntsville officers on July 19, 2021. ….Burton… was confused about his work schedule when he walked to an apartment complex thinking he would be picked up to go to work, according to the lawsuit. The complex’s security guard called authorities, saying Jeffrey Burton either had a ‘mental issue’ or was ‘high on drugs’. Nearby patrol officers arrived on the scene and drew their weapons, the suit claimed, although Jeffrey Burton was not armed and the security guard told them she did not believe he had a weapon. His attorneys also claimed he was not aggressive or combative toward the officers. The officers ‘proceeded to shock Jeffrey multiple times with stun guns, force him to the ground, pull his pants down, and handcuff him behind his back,’ the suit alleged. New York City council votes to end long-term solitary confinement in city’s jails. “New York City on Wednesday voted to ban solitary confinement in city jails on the grounds that the practice has caused psychological harm and led to increased death and violence in these institutions. ….’The physical and psychological harm caused by solitary confinement leads to increased death and violence in jails, endangering those incarcerated, as well as correction officers and staff.’ Under current rules, jail officials can punish violent inmates by isolating them in a cell for up to 23 hours a day for up to 60 days straight for the most serious infractions. The new rules will allow a detainee to be placed into “de-escalation confinement” for up to four hours after an episode of violence, with wellness checks by jail staff every 15 minutes. The bill also allows any detainee found to have committed a serious infraction to be transferred from a jail’s general population to restrictive housing for up to 60 days in a single year. But the detainee cannot be isolated in a cell away from shared areas for more than 10 hours a day. NYPD officers now required to report ‘low-level’ encounters with public, voluntary search refusals. “The NYPD is already mandated to document stops where officers detain people even briefly, including stops, frisks and arrests. Now, officers have to report low-level stops, including when an officer asks someone for their ID, where they’re going or for voluntary consent to search them. Council member Alexa Avilés, who introduced the [How Many Stops Act] with Public Advocate Jumaane Williams, previously told Gothamist the goal is to gain an understanding of what really happens on the street. ‘We’re trying to understand the scale and scope of policing in New York City,’ said Avilés, who introduced the bill in July 2022. The second bill in the package, introduced by Council member Crystal Hudson, will require police to report when someone does not consent to an officer search. St. Louis cops who crashed into bar also ran red light just before accident, claims attorney. “The lawyer representing two bar owners on Wednesday night posted a video that he says shows a police SUV blowing through a red light just seconds before it crashes into the couple’s south St. Louis bar. The footage is taken at a stoplight about three seconds before the SUV crashes into Bar:PM on South Broadway. It was given to attorney Javad Khazaeli on Wednesday evening by the same person who provided earlier footage of the crash, Khazaeli said. ….’If any other citizen were to go through a red light, lose control and crash into a building, they would be investigated.’ ….St. Louis police Lt. Col. Renee Kriesmann said Wednesday the officers who crashed into the bar were not tested for drugs or alcohol because other officers who were investigating the crash did not have reasonable suspicion of impairment, which department policy requires for toxicology tests. ….The attorney said police at first told… James Pence, that they swerved to avoid hitting a dog in the road. Shortly after that, Pence said they changed the story and said they swerved to miss a parked car. Man imprisoned by Oklahoma for 48 years declared ‘not guilty’. “Oklahoma County District Court Judge Amy Palumbo ruled in favor of Glynn Simmons, 71, updating the dismissal of his murder conviction with a declaration of “actual innocence” Tuesday. Simmons had been convicted of the December 1974 murder of Carolyn Sue Rogers, who died after being shot during an Edmond liquor store robbery. Census shows shift in population from northeast and west coast to south. “The top six states that saw the biggest numeric growth are all in the South. Texas led the way with 473,000 people, followed by Florida’s estimated 365,000 [in population] growth. North Carolina, Georgia, South Carolina and Tennessee then followed. Arizona, classified as a western state, was seventh. Eight states saw a net drop in population: California, Hawaii, Illinois, Louisiana, New York, Oregon, Pennsylvania and West Virginia. Albuquerque, New Mexico Wells Fargo employees vote in favor of union representation. “… Wells Fargo has become the first major U.S. lender to have a unionized workforce. 29 employees at Tennessee cheese factory hospitalized after two ammonia leaks. “The Greeneville fire department was first called to La Quesera Mexicana at 7:15 am when a leak occurred during maintenance on a valve. Six people were hospitalized at the time. ‘The leak was contained and fixed at that moment. And the scene was certified as safe,’ Smith said. However, a second call about a leak came in at 10:01 am. A further 23 people were hospitalized and 53 other employees were evaluated for possible illness, Smith said. Anhydrous ammonia can irritate or damage the lungs and burn the eyes and skin.
